healthcare reform and recovery


Here is a brief synopsis of some changes in the new healthcare reform bill passed this week with regard to substance use and mental health disorders. of course, this is merely an overview, but it does give an indication as to the fresher perspective (and much needed) and possible new approach to these very abundant needs. this information was produced by the Legal Action Center.

federal healthcare bill becomes law, includes major ADDICTION AND MENTAL Illness Prevention, Treatment and Recovery Provisions


Today, President Obama signed into law H.R. 3590, the “Patient Protection and Affordable Care Act.” The new law, approved by the U.S. Senate on December 24, 2009 and the U.S. House of Representatives on March 21, 2010, is expected to expand healthcare coverage to tens of millions of Americans that are currently uninsured, resulting in 95 percent of the legal population being covered.
The new federal healthcare law includes a number of provisions aimed at improving coverage for and access to substance use disorder and mental illness prevention, treatment, and recovery services, a result of strong bi-partisan support in Congress and by the Obama Administration in addition to a unified and coordinated effort by advocates for people in need of substance use disorder and mental illness prevention, treatment and recovery support services.

The following is an overview of key components of the final legislation, including critically important addiction and mental health provisions included in the new law. The below also highlights provisions in the House-approved reconciliation bill, which would amend certain provisions of the new law unrelated to the addiction- and mental health-specific provisions listed below. The reconciliation bill is expected to receive a Senate vote later this week.


Major substance use disorder and mental health provisions in the new law include:

F0B7 Substance use disorder and mental health (SUD/MH) services in the basic benefit package. The final bill requires a basic benefit package for all health plans in the individual market and small group markets. All such plans will be required to cover mental health and substance use disorder services.
F0B7 The requirement that all plans in the health insurance exchange adhere to the provisions of the Wellstone/Domenici Parity Act. The final bill requires all group and individual plans to comply with Wellstone/Domenici, which requires that SUD/MH benefits be provided in the same way as all other covered medical and surgical benefits.

F0B7 The requirement that newly-eligible Medicaid enrollees, including childless adults, receive adequate health coverage that includes SUD/MH coverage. The final bill expands Medicaid eligibility to all Americans up to 133 percent of federal poverty and requires that all newly eligible parents and childless adults receive basic benefits, including SUD/MH services that must be provided at parity.
F0B7 SUD/MH in chronic disease prevention initiatives. The final bill creates a national prevention council with the ONDCP Director as a member and SUD listed as a national priority for that council’s report to Congress. SAMHSA is required to be consulted on issues related to preventing SUD and mental illness.
F0B7 SUD/MH MH workforce in health workforce development initiatives. The final bill includes the capacity of the MH and “behavioral health” workforce as high-priority topics in the bill’s National Workforce Strategy section.
F0B7 SUD prevention, treatment, and MH service providers to be eligible for community health team grants aimed at supporting medical homes. The final bill lists SUD and MH service providers among entities eligible for community health team grants.
Additional key provisions of the new law will:
F0B7 Expand Medicaid coverage to all Americans below 133 percent of the federal poverty level. This will expand coverage to an additional 16 million Medicaid beneficiaries, including childless adults for the first time in many states. 

F0B7 Create health exchanges for individuals and small employers to pool risk and purchase insurance. The exchanges seek to improve individual and small group insurance coverage by requiring transparency, mandated benefits and other types of consumer protections.


F0B7 Provide sliding scale subsidies for individuals and families up to 400 percent of the federal poverty level to purchase or take up offers of health coverage.
F0B7 Prohibit insurers from denying coverage to people with pre-existing conditions, charging higher premiums based on gender or health status, and placing annual or lifetime caps on insurance coverage.
F0B7 Require individuals to carry health insurance or pay a financial penalty. The individual mandate seeks to ensure that risk is pooled among both healthy and non-healthy individuals, lowering costs and reducing the opportunity for people to wait until they are sick to access care.

F0B7 Close the Medicare “donut hole”. This provision in the House-approved reconciliation bill seeks to lower out of pocket prescription drug costs for Medicare beneficiaries.


F0B7 Allow adult children to remain on their parents’ insurance until their 27th birthday.


F0B7 Create a national high risk pool for adults with preexisting conditions. Adults with pre-existing medical conditions will be able to buy into a national high risk pool until the health exchanges are implemented.
F0B7 Reduce the federal deficit by $138 billion over the next 10 years and $1.3 trillion over the following 10 years. According to Congressional Budget Office estimates, the new law and House-approved reconciliation package pending in the Senate will result in significant reductions to the federal deficit.


Legal Action Center is continuing to analyze the new federal law and will release more analysis in the coming days and weeks. The full impact of many provisions will remain unclear until details are worked out through the regulatory process.

"FREE" booth for your Organization!

Surrounded by Recovery - Colorado (SBR) is a group of individuals in long-term recovery from substance abuse committed to spread the word that recovery is possible and does happen. As people in recovery we all have firsthand knowledge of how difficult the first step can be.
To encourage others and spread the word about recovery, SBR is hosting the third annual “Recovery at the Capitol 2010” event. On the West steps of the Colorado State Capital on Friday May, 21, 2010, between the hours of 10:30 a.m. and 1:30 p.m., we will have speakers and informational booths from agencies within the state that provide services or support for those in recovery. Box lunches will also be provided by Cindy Lynn Café to the first 500 people that request ticket for the lunch

To embody the power of recovery, the demonstrators will surround the capital hand in hand. There will be an open space in the chain. This gap serves as a reminder that there are those who have died from substance abuse and to symbolize that there is an open door to recovery for anyone who still suffers.

If you are a recovery friendly company or a provider of recovery services, either support or treatment and would like a free booth, I need to hear from you ASAP! Space is filling up fast; first come first served on spaces available. The deadline to RSVP is May 12, 2010.

If you are a treatment center from out of State no worries you can have FREE space too, just give me a call @ 303-882-2172 and I will give you all the info you need to get your materials to the rally. This is a global issue and we don't want anyone to miss out as we hope to build chapters of SBR in every State with our focus on a yearly rally where we will find ourselves in Washington D.C. and March from the White House to the U.S. State Capital. For those that have attended the Colorado SBR events and felt the power of being hand in hand around our State Capital. Imagine surrounding the U.S. Capital. IT WILL HAPPEN!!

recovery at the capital 2010

It's that time again to join Surrounded by Recovery - Colorado as we host the 3rd annual Recovery at the Capitol 2010. On Wed. May 19th, 2010 from 10:30am to 1:30pm on the west steps of the Colorado State Capitol. More information to follow, so come on back and check out where we're at.

ACTION ALERT!!!! SBR needs your help as we plan for this year's rally. We need volunteers to commit to helping us on May 19th, but we also need your help now as we plan this event. So now is the time to tell us what you want at your rally, and don't think your suggestion may be too off the wall we want to hear what you have to say! All suggestions will be addressed by SBR board members.

SBR is also trying something new this year; we want to supply box lunches for the attendees of this rally so we are asking for your support. All we are asking for is a donation from you of only $5 Bucks, that's it!! This will help offset the cost for these wonderful lunches provided by Cindy Lynn Cafe. Donations can be made by dropping a check in the mail made out to: Surrounded by Recovery, and in the memo line at bottom left put ("Box Lunch Drive"). Addressed to PO Box 16523 Denver, CO 80216. ring a belle


it is a long road- this road of recovery- at least for me. i have so much to get in sync with. outside of these 5 years, i have never really been without a cigarette in my hand, a drink on the bar, or a baggie of some sort in my pocket. there has always been an escape hatch from being just where i am.

of course, things are different now. but the surprises of just how "where i am" feels are still coming forward. i realize that i am more selfish than i'd like to be. i am much much much more fearful than i'd like, and i misread others reactions and intereactions with the finesse of that deaf, dumb, and blind pinball wizard. i am adept at playing a specific game, but really stumble with the rest of life.

the horoscope i posted a couple of days prior has me rethinking. according to the stars, i am working on knowing myself better, understanding the strong and the not-so-pretty things about myself. only then can i go forward into the world with a true representation of who i am and interact with the parts of life that i am meant to. i suspect i am working on this, but i can only imagine if i am making headway.

i know that i am excited about the next phase of my life. i am in fear, yes, but overall i am feeling motivated for something really wonderful. but moving forward with the truth about myself does not seem a simple task. i am often disappointed that i have the feelings i have. i think- damn! i should be much more adult than this in this situation. but the truth is that my initial reactions to things are very very immature and self-serving.  it is continuous work to move past this. and then there's the second tier of childishness.

anyway, i am babbling like a brook right now, mostly because i have a cold and i've been house-ridden for a couple of days. an old friend posted photos on fb and i have been tripped by them too, i suppose. i had never seen a photo with the hair extensions i got in 1984 during a trip to nyc. seeing them reminds me of how i used to be. and also reminds me that in many ways, i probably never really saw how i was.

i hope that is changing.

virgo- week of 2/15-2/21


the finger of god aspect that perfects all week is activating your 12th house of the unconscious, your 2nd house of self-worth and abundance and your 7th house of relationships. on monday mars sextiles saturn helping you to do the deep internal work required of you around your deepest hopes and fears and how they inform your self-worth and ability to embrace all that the Universe wants to give to you. both bodies are retrograde so this is very much an internal process. on tuesday neptune and chiron cojoin in your 6th house of work, service and well being. this long-awaited aspect has been instigating a deeply spiritual healing journey over the past year. connecting to your body and the work that you are here to do in profound ways is the gift of these two, and on the heels of the new moon last week amazing new things related to work and service are being set into motion! venus cojoins jupiter in your 7th house of committed relationships the same bringing opportunities for Divine Love connections with significant others. on thursday the sun moves into pisces and your 7th house and makes the finger of god aspect with mars and saturn over the weekend. if you put energy and commitment into yourself and your inner process the rewards will reveal themselves in your important relationships. you cannot truly meet another from a place of equality until you realize all that you are- the light and the shadow. once you do this you will meet someone from your center and if they are ready to meet you from theirs you are entering the new paradigm of partnership territory. it all starts with self-Love.
